On The Horns of the Discipline Dilemma

B. Delahaye

Legal implications are impinging very strongly on the domain of Human Resource Management and this is most evident in the discipline function. This paper examines some of the legal issues involved in discipline that results in termination and recommends an approach called the 'due process' of discipline. (Although this is, to an extent, a 'marrying' of the legal and human resource management requirements, the writer is not engaged in rendering legal or other professional service. So in the best legal tradition, the writer would advise that if legal advice or other expert assistance is required, the service of a competent professional person should be sought.)
